Manual published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 ("PAIA"), read with the Protection of Personal Information Act 4 of 2013 ("POPIA").
This manual explains what records 745 Transport holds, and how you may request access to them. It applies to anyone — you do not have to be a passenger or a driver-partner to make a request.

3. Records Held by 745 Transport
The categories below describe the records we hold. Listing a category here does not mean every record in it is automatically available — access is decided against the grounds for refusal in Chapter 4 of PAIA, summarised in section 6 below.
3.1 Records held about users of the platform

3.3 Company records
Statutory and company-secretarial records; financial and tax records; employment and payroll records; contracts with suppliers, clients and driver-partners; insurance records; and internal policies and operating procedures.
3.4 Records held in terms of other legislation
Records kept under, among others, the Companies Act 71 of 2008, the Income Tax Act 58 of 1962, the Value Added Tax Act 89 of 1991 (see note below), the Basic Conditions of Employment Act 75 of 1997, the Labour Relations Act 66 of 1995, the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, POPIA, and the National Land Transport Act 5 of 2009.
745 Transport is not a registered VAT vendor. No VAT is charged on fares, bundles or 745 Shield credits, and no VAT records are kept.
4. Requesting Access to a Record
4.1 Your own personal information
If you want access to the personal information 745 Transport holds about you, you do not need to use the PAIA form. Email the Information Officer at support@745.co.za, and we will verify your identity and respond. This is free.
4.2 Any other record
A request for any other record must be made on the prescribed form (Form 2 of the PAIA Regulations), sent to the Information Officer at the address in section 1. The request must:
- give enough detail about the record for us to identify it;
- give the form of access you want (inspection, a copy, an electronic copy);
- give an address, email address or fax number in South Africa where we can reach you;
- state whether you want to be told about the decision in any other manner, and give the necessary particulars; and
- if the request is made in the public interest or in the interest of another person, state which right is being exercised or protected, and explain why the record is required to exercise or protect it.
4.3 Requesting on behalf of someone else
If you are requesting a record on behalf of another person, the request must state that, and you must attach proof of your authority to act — a power of attorney, a court order, or the written consent of the person concerned.

We will tell you the amount payable before doing the work, and you may lodge an internal appeal or apply to court against a fee you believe is excessive.
6. Grounds on Which a Request May Be Refused
PAIA obliges us to refuse a request in some circumstances and permits us to refuse it in others. The main grounds are:
- Protection of another person's privacy — the unreasonable disclosure of someone else's personal information (section 63). This is the ground most often engaged on this platform, because a trip involves at least two people, and a passenger's record is also a driver's record.
- Commercially sensitive information of a third party — trade secrets, or financial, commercial, scientific or technical information whose disclosure would harm someone's commercial interests (section 64).
- Confidential information supplied by a third party — where disclosure would breach a duty of confidence (section 65).
- Safety of individuals and protection of property — where disclosure could reasonably endanger someone's life or physical safety, or prejudice the security of property or a system (section 66). Safety-incident and live-location records frequently engage this ground.
- Legally privileged records (section 67).
- Research information of the body or a third party (section 69).
Where a record can be separated, we will give you the part that is not protected rather than refusing the whole request (section 28).
If we refuse, we will tell you in writing, give adequate reasons, and set out your right to lodge an appeal or apply to court.
7. Timeframes
We must decide on a request within 30 days of receiving it, and tell you the outcome. That period may be extended by up to a further 30 days where the request is for a large number of records or requires a search through records held elsewhere; if we extend, we will tell you in writing, with reasons, before the first 30 days expire.
8. Remedies
745 Transport is a private body, so there is no internal appeal. If you are not satisfied with a decision, you may:
- Complain to the Information Regulator — inforeg@justice.gov.za, using the Regulator's complaint form; or
- Apply to court for appropriate relief, in terms of section 78 of PAIA.
A complaint to the Regulator must generally be lodged within 180 days of the decision.
9. Your Rights Under POPIA
Separately from PAIA, POPIA gives you the right to ask what personal information we hold about you, to have it corrected or deleted where it is inaccurate, irrelevant, excessive, out of date, incomplete, misleading, or obtained unlawfully, and to object to processing in certain circumstances.

10. Availability of This Manual
This manual is available free of charge:

- for inspection at our registered address during ordinary business hours.
11. Updates
This manual is reviewed at least annually and whenever our records or processing change materially. The effective date at the top reflects the current version.
